Rapanos v. United States
Rapanos v. United States, 574 U.S. ____ (2006), is a decision of the Supreme Court of the United States that has greatly hindered decision making in regards to Section 404 permitting under the Clean Water Act. The City of Horton is currently engaged in making a Jurisdictional Determination to the USACE to determine whether a Section 404 permit is necessary for the fill or for the return flows from the confined disposal facility.
